本章小结

“计算机实施的发明”是指通过计算机程序的运行实施全部或者部分发明,其中使用了计算机、网络或者其他可程序化的设备。在人工智能技术革命的浪潮下,这类发明具有四个方面的主要特征:一是跨学科性,这一点与新颖性和创造性评价过程中,法律拟制的判断主体“本领域普通技术人员”及其所掌握的一般知识和技能的认定有着密切的联系;二是以算法为中心,以大数据为支持,而数学公式和计算方法是计算机程序算法的根基,这也是将基于算法的软件相关发明排除在可专利客体之外的理由之一;三是累积性软件创新,从软件研发的过程来看,一项新的软件是从抽象的理念演进为程序员撰写的代码,难以区分软件相关发明属于抽象思想还是抽象思想的实际应用,加剧了客体适格性判断的不确定性,就整个软件产业发展的开端和现状而言,以专利制度保护软件发明存在诸多不便;四是过于宽泛的专利权利要求,说明书没有充分披露功能性特征的具体实现方式,给现有技术检索制造了障碍。尽管各国和地区专利局允许采用方法或者装置、系统和存储介质等不同类型的权利要求,但可专利性审查的重点是发明的实质性内容而不是权利要求的撰写形式。最后,鉴于实用性的探讨在实践中极少有争议,结合国际上关于可专利性的通行解释,以及最新的审查实践,本书将分别从客体适格性、新颖性和创造性层面研究计算机实施的发明之可专利性问题。
